Klauzula informacyjna do procesu rekrutacji

Działając w imieniu Międzynarodowego Instytut Biologii Molekularnej i Komórkowej z siedzibą w Warszawie (02-109), przy ul. Księcia Trojdena 4 (dalej: „MIBMiK”), NIP: 5262278704, REGON: 013082798, na podstawie art. 13 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z 27 kwietnia 2016 roku w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz. Urz. UE L 119, s. 1) (dalej: „RODO”), niniejszym informujemy, iż:

1. Administratorem Danych Osobowych przetwarzanych w ramach procesu rekrutacji jest MIBMiK.

3. 4. Dane osobowe będą przetwarzane w celu przeprowadzenia obecnego postępowania rekrutacyjnego, a w przypadku wyrażenia zgody, także w kolejnych rekrutacjach na podstawie wyrażonej przez Panią/Pana zgody (art. 6 ust. 1 lit. a RODO).

5. W ramach procesów rekrutacyjnych Administrator oczekuje przekazania danych osobowych (np. w CV lub liście motywacyjnym) jedynie w zakresie określonym
w przepisach prawa pracy. Jeżeli kandydat poda także inne dane, niewymagane przez Administratora, uznaje się, że wyraził zgodę na ich przetwarzanie, przy czym taka zgoda może być wycofana w każdym czasie, bez wpływu na zgodność z prawem przetwarzania dokonanego przed jej wycofaniem. W razie, gdy przesłane aplikacje będą zawierać informacje nieadekwatne do celu, jakim jest rekrutacja, nie będą one wykorzystywane
ani uwzględniane w procesie rekrutacji.

6. Dane zgromadzone w procesach rekrutacyjnych będą przetwarzane:

a) w celu wykonania obowiązków wynikających z przepisów prawa, związanych z procesem zatrudnienia, w tym przede wszystkim Kodeksu pracy – podstawą prawną przetwarzania jest obowiązek prawny ciążący na Administratorze (art. 6 ust. 1 lit c RODO w związku z przepisami Kodeksu pracy);

b) w celu przeprowadzenia procesu rekrutacji w zakresie danych niewymaganych przepisami prawa, a także dla celów przyszłych procesów rekrutacyjnych – podstawą prawną przetwarzania jest zgoda (art. 6 ust. 1 lit a RODO);

c) w celu ustalenia lub dochodzenia ewentualnych roszczeń lub obrony przed takimi roszczeniami – podstawą prawną przetwarzania jest prawnie uzasadniony interes Administratora (art. 6 ust. 1 lit f RODO).

7. W związku z prowadzeniem działalności wymagającej przetwarzania danych osobowych, dane osobowe mogą być ujawniane zewnętrznym podmiotom, w tym w szczególności podmiotom świadczącym usługi IT w zakresie serwisowania i usuwania awarii, podmiotom świadczącym usługi księgowe, podmiotom mogącym udzielić Administratorowi informacji o wydanym przez zagraniczną uczelnię dyplomie kandydata do pracy jak również jego poziomie studiów i statusie uczelni - zgodnie z art. 326 ust. 4 ustawy Prawo o szkolnictwie wyższym i nauce czy też podmiotom współpracującym z Administratorem w zakresie realizacji projektów badawczych, jeżeli osoba zainteresowana zostanie w taki projekt zaangażowana, w szczególności:

a) w przypadku realizacji Projektów finansowanych przez Narodowe Centrum Nauki odbiorcą danych będzie Narodowe Centrum Nauki w Krakowie z siedzibą przy ulicy Twardowskiego 16, 30-312 Kraków, NIP: 676-242-96-38 (dalej: „NCN”).

b) w przypadku realizacji Projektów finansowanych przez Narodową Agencję Wymiany Akademickiej odbiorcą danych będzie Narodowa Agencja Wymiany Akademickiej z siedzibą przy ulicy Polnej 40, 00-635 Warszawa, NIP: 5272820369; (dalej: „NAWA”)

c) w przypadku realizacji Projektów finansowanych przez Fundację na rzecz Nauki Polskiej odbiorcą danych będzie Fundacja na rzecz Nauki Polskiej z siedziba przy
ul. I. Krasickiego 20/22, 02-611 Warszawa, NIP: 5260311952 (dalej:”FNP”). Treść klauzuli informacyjnej FNP znajduje się tutaj https://www.fnp.org.pl/ochrona-danych-osobowych/ ;

d) w przypadku realizacji Projektów finansowanych przez Narodowe Centrum Badań i Rozwoju odbiorcą danych będzie Narodowe Centrum Badań i Rozwoju z siedzibą przy ul. e) w przypadku realizacji Projektów finansowanych przez Ministerstwo Edukacji i Nauki odbiorcą danych będzie Ministerstwo Edukacji i Nauki z siedzibą przy ul. Wspólnej 1/3, 00-529 Warszawa, NIP 7011010460 (dalej: „MEiN”). Odbiorcami danych osobowych mogą być również zagraniczne agencje finansujące, a także inne agencje lub instytucje, które mogą stanowić źródło finansowania. Wspomniane instytucje każdorazowo będą wskazywane w umowie o pracę.

8. W przypadku danych osobowych przetwarzanych na podstawie uzasadnionego interesu Administratora są one przetwarzane przez okres umożliwiający realizację tego interesu lub do zgłoszenia skutecznego sprzeciwu względem ich przetwarzania. Jeżeli przetwarzanie odbywa się na podstawie zgody, dane przetwarzane są do jej wycofania. Dane przetwarzane na podstawie obowiązku prawnego ciążącego na Administratorze przetwarzane są do czasu istnienia tego obowiązku wynikającego z poszczególnych przepisów prawa.

9. Administrator Danych Osobowych nie przekazuje danych poza EOG.

10. Osobie, której dane dotyczą przysługują następujące prawa:

a) prawo do informacji o przetwarzaniu danych osobowych;

b) prawo uzyskania kopii danych;

c) prawo do sprostowania danych;

d) prawo do usunięcia danych;

e) prawo do ograniczenia przetwarzania;

f) prawo do przenoszenia danych;

g) prawo wycofania zgody.

11. Osobie, której dane dotyczą przysługuje ponadto prawo wniesienia skargi do Prezesa Urzędu Ochrony Danych Osobowych na niezgodne z prawem przetwarzanie jej danych osobowych. Organ ten będzie właściwy do rozpatrzenia skargi z tym, że prawo wniesienia skargi dotyczy wyłącznie zgodności z prawem przetwarzania danych osobowych, nie dotyczy zaś przebiegu procesu rekrutacji.

12. Podanie danych zawartych w dokumentach rekrutacyjnych nie jest obowiązkowe, jednak jest warunkiem umożliwiającym ubieganie się o przyjęcie kandydata do pracy.

4. Personal data will be processed for the purpose of the current recruitment procedure and, in the case of consent, also in subsequent recruitments on the basis of your consent (Article 6(1)(a) of the GDPR).

5. As part of the recruitment processes, the Administrator expects the transfer of personal data (e.g. in a CV or cover letter) only to the extent specified in the provisions of Labour Law. If the candidate also provides other data not required by the Administrator, it will be assumed that the candidate has given his consent to the processing of such data, whereby such consent may be withdrawn at any time, without affecting the legality of the processing performed prior to its withdrawal. If the submitted applications contain additional information, which is not relevant to the purpose of the recruitment,
it will not be used or considered in the recruitment process.

6. The data collected in the recruitment processes will be processed:

a) in order to comply with legal obligations arising from the employment process, including in particular the Labour Code – the legal basis for the processing of personal data is a legal obligation incumbent on the Administrator (Article 6(1)(c) of the GDPR in relation to the provisions of the Labour Code);

b) in order to conduct the recruitment process in the scope of data not required by law, as well as for the purposes of future recruitment processes – the legal basis for processing is the consent of the candidate (Article 6(1)(a) of the GDPR);

c) in order to possibly set and enforce claims or defend against them – the legal basis of the processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR).

7. In association with the performance of activities that require the processing of personal data, personal data may be disclosed to external entities, including in particular IT service providers in the field of maintenance and fault repair, entities providing accounting services, entities that can provide the Administrator with information about the candidate’s diploma issued by a foreign university as well as his/her level of studies and university status (in accordance with Article 326(4) of the Act on Higher Education and Science), or entities that cooperate with the Administrator in the implementation of research projects, if the candidate becomes involved in such a project, in particular:

a) in the case of projects funded by the National Science Center, the recipient of the data will be the National Science Centre in Cracow, located at 16 Twardowskiego Street, 30-312 Cracow, NIP: 676-242-96-38 (hereinafter: “NCN”).

b) in the case of Projects funded by the National Agency for Academic Exchange, the recipient of the data will be the National Agency for Academic Exchange, located at 40 Polna Street, 00-635 Warsaw, NIP: 5272820369 (hereinafter: “NAWA”);

c) in the case of Projects funded by the Foundation for Polish Science the recipient of the data will be Foundation for Polish Science, located at

d) in the case of execution of Projects financed by the National Centre for Research and Development, the data recipient will be the National Centre for Research and Development, located at 47a Nowogrodzka Street, 00-695 Warsaw, NIP: 7010073777 (hereinafter referred to as: “NCBR”). e) in the case of projects funded by the Ministry of Education and Science, the recipient of the data will be Ministry of Education and Science, located at 1/3 Wspólna Street, 00-529 Warsaw, NIP 7011010460 (hereinafter: “MEiN”). The recipients of personal data may also be foreign funding agencies as well as other agencies or institutions that may constitute a source of financing. The institutions mentioned will be indicated in the employment contract every time.

8. In the case of data processing on the basis of the Administrator’s legitimate interest, the data is processed for a period of time enabling the implementation of this interest or to enable an effective objection to data processing. If the processing is based on consent, the data is processed until it is withdrawn. Data processed on the basis of a legal obligation incumbent on the Administrator shall be processed until the existence of such an obligation arising from individual provisions of law.

9. The Personal Data Administrator does not transfer data outside the EEA.

10. The candidate whose data is processed has the following rights:

a) the right to be informed about the processing of personal data;

b) the right to obtain a copy of the data;

c) the right to rectify the data;

d) the right to delete the data;

e) the right to limit data processing;

f) the right to transfer data;

g) the right of withdraw consent.

11. The candidate whose data is processed has the right to lodge a complaint with the President of the Office for Personal Data Protection regarding the unlawful processing of his/her personal data. This authority will be competent to deal with the complaint, however, the right to file a complaint concerns only the lawfulness of the processing of personal data, not the course of the recruitment process.

12. Providing data contained in recruitment documents is not mandatory, however, it is a condition necessary to fulfil when applying for job position.
